Auseinandersetzungs-Rezess von Gembitz Hauland

Negotiated in Gembic the 14 December 1835

In the dispute of Gembic-Holland is today for the completion of the recess appointment, in which are present:

    1. for Johann Scheffler, his son-in-law Gottlieb Krueger, with the notification that the former had judicially surrendered his property several years ago to him, the guarantor and his wife Susanna née Scheffler, who lives with him in the community of property, and that he will surrender his mortgage bill tomorrow for the files.

    1. for Johann Samuel Warnke his son-in-law Michael Hanefeld with the statement that his father-in-law has jointly assigned the property to him, the landowner and his wife Anna Rosina née Warnke, who lives with him in joint property, he reserves the right to subsequently submit the mortgage certificate to the records for his legitimacy.

A copy of the deed due for this was not received by him, which is why he asks to obtain a copy for his legitimacy from the county and city court in Schoenlanke.

    1. Johann Kassner has failed to appear. In regard to him, the guarantors indicate that he had died two years ago, the remaining heirs had divided the estate, and the son-in-law of the deceased, or rather, as the guarantors now improve, the widow of the deceased, Anna Maria Eilfmann, had legally taken over the property.

Of the hauländer landlords listed as present, Martin Krueger named number 1 and Michael Krueger II named number 36 have exchanged their properties for one another, so that Martin Krueger acts for the property of Michael Krueger II designated in the recess and the latter for the property of Martin Krueger designated in the recess. 

All present are capable of disposition and the lord of the manor is well known, but the landowners are not, however, recognized by the lord of the manor, Mr. Bernhard Jankowski, known to the signed deputy, for those for whom they give themselves to us.

The resolution on the settlement of the dispute, consisting of its parts, dated today and signed by the special commissioner appointed by the Royal General Commission on the matter, was slowly and clearly read out to those present and, if it was appropriate, explained to them:

that by the execution of the recession the whole dispute procedure is terminated in such a way that the interested parties are not only not subject to any deposits because of the objects determined therein, but also not subject to any further claims to rights which they are entitled to, but which might be concealed here.

They declare:

that they had understood this reproach well, but nevertheless approved the dispute recess imposed on them in all its pacts and clauses and wanted to be bound to it forever.

They then execute the recession by their signatures and also this protocol after it has been read to them and approved by them before the court.
